SISTEM KEADILAN JENAYAH : JAMIN ( SAMBUNGAN )

Jumlah jamin.

389. Amount of bond
The amount of every bond executed under this Chapter shall be fixed with due regard to the circumstances of the case as being sufficient to secure the attendance of the person arrested, but shall not be excessive; and a Judge may, in any case, whether there be an appeal on conviction or not, direct that any person be admitted to bail or that the bail required by a police officer or Court be reduced or increased.

-Jumlah jamin hanya cukup untuk kehadiran orang ditangkap dan tidak berlebih-lebih.

1) SOO SHIOK LIONG V PENDAKWA RAYA [1993] 2 MLJ 381

[13 tuduhan dikenakan kerana bersubahat dibawah seksen 406 melibatkan nilai RM5 juta. Jamin dikenakan RM 1 juta dan dua penjamin. Oleh kerana tertuduh tidak boleh mengemukakan jamin maka dia di tahan di penjara. Rayuan dibuat dan jamin dikurangkan kepada RM600/- ribu. Hakim memberi komen ianya cukup sekadar untuk mendapat kehadiran seperti dibawah seksen 389 CPC]

2) ZULKIFFLEE BIN HJ HASSAN v PUBLIC PROSECUTOR [1987] 2 MLJ 527

[Tuduhan CBT oleh orang gaji dibawah seksen 409KK. Jamin diberikan 1juta. Permohonan dibuat untuk mengurangkan bail. Permohonan dilulus kepada 200 ratus ribu.
Hakim memberi komen, tujuan jamin adalah untuk kehadiran tertuduh pada tarikh tertentu untuk menjawab pertuduhan dan jamin tidak berniat untuk menghukum]

3) LOW CHIT BAH V PUBLIC PROSECUTOR [1986] 1 MLJ 297

[41 Tuduhan kerana bersubahat menipu dibawah seksen 420 dengan jumlah hampir 4 juta. Jamin dikenakan 1 juta. Permohonan pengurangan dibuat. Permohonan telah ditolak kerana tertuduh pernah membuat perjalanan dengan passport Filipina palsu dan juga mempunyai passport sah Cina. Hakim memberi komen ada kemungkinan tertuduh akan melarikan diri dan dengan itu jumlah yang dikenakan tidak terlalu banyak]

4) LIM KIAP KHEE v PUBLIC PROSECUTOR [1988] 1 MLJ 198

[Tuduhan CBT seksen 409 KK iaitu kesalahan tidak boleh dijamin. Setelah jamin ditawarkan, President mengenakan syarat jamin iaitu passport antarabangsa dirampas.Rayuan dibuat keatas perintah ini. Diputuskan mahkamah tidak boleh mengeluarkan arahan menahan passport sebagai syarat]

5) DATO’ MAT SHAH LWN PENDAKWA RAYA [1991] 2 MLJ 125

[ Mahkamah Tinggi boleh mengubah suai syarat jamin yang dibuat oleh mahkamah rendah walaupun ianya tidak tercatit dibawah seksen 389 CPC]

Jamin tunai tidak dibenarkan mengikut seksen 403 CPC.

403. Deposit instead of bond
When any person is required by any Court or officer to execute a bond, with or without sureties, the Court or officer may, except in the case of a bond for good behaviour, permit him to deposit a sum of money to such amount as the Court may fix, instead of executing the bond.

6) Lau Kung Seng & Ors v Public Prosecutor [1997] 5 MLJ 323

[ Jamin tunai tidak dibenarkan dibawah seksen 403 CPC . petikan hakim `Sections 390 and 391 should be read together with s 403. When a person is required to execute a bond with or without sureties, the person may be permitted to deposit money. This deposit is in lieu of executing a bond. In my view, s 403 read with s 390 does not permit cash bail to be imposed]

Di England jamin tidak perlu mengemukakan deposit sebarang duit atau cagaran seperti di amalkan di Malaysia. Jamin dirujuk sebagai janji untuk membayar sekiranya apa-apa syarat di langgari.

Jamin hendaklah dibenarkan apabila menunggu rayuan. Seksen berkaitan adalah seksen 57 CJA.

57. Appeal not to operate as stay of execution
(1) Except in the cases mentioned in subsection (3) and section 56A, no appeal shall operate as a stay of execution, but the High Court or the Court of Appeal may stay execution on any judgement, order, conviction, or sentence pending appeal on such terms as to security for the payment of any money or the performance or non-performance of any act or the suffering of any punishment ordered by or in the judgement, order, conviction, or sentence as to the Court may seem reasonable.

Seksen yang sama mengenai rayuan adalah dibawah seksen 394 CPC.

394. Appeal
Any person aggrieved by any order or refusal of any inferior Court made under this Chapter may appeal to the High Court, which may confirm, vary or reverse the order of the inferior Court.

Kedua-dua seksen ini menunjukkan jamin boleh dibuat rayuan.

Permohonan untuk mengurangkan jamin juga tidak perlu dibuat melalui rayuan dan cara yang lebih cepat dinamakan ` notice of motion` dibawah seksen 389 CPC.

7) SULAIMAN BIN KADIR v PUBLIC PROSECUTOR [1976] 2 MLJ 37

[ Tuduhan adalah kes rogol. Permohonan jamin dipohon dibuat dibawah seksen 389 dan bukan dibawah seksen 394 KK. Isunya adakah permohonan dibawah seksen 389 wajar. Diputuskan ianya adalah wajar berdasarkan sebab khas]

8) KHOR SWEE KHIM v PUBLIC PROSECUTOR; [1953] 1 MLJ 117
WAN BIN ABDULLAH
[Rampasan bon jaminan oleh mahkamah tidak boleh dirayu. Nota : Rampasan bon jaminan dibawah seksen 404 dan ianya boleh di rayu dibawah seksen 405 CPC –selepas 31 Julai, 1998. ]

9) MOHAMED RAZIP & ORS V PUBLIC PROSECUTOR [1988] 1 MLJ 84 ( kes Singgapore)

[ Jamin tidak boleh dirayu ke mahkamah rayuan kerana mahkamah rayuan hanya mendengar sesuatu keputusan yang berbentuk muktamat sahaja dan bukan dalam bentuk permohonan yang boleh diubah ( jamin boleh diubah mengikut keadaan -rujuk kepada kes Dato Daud. Di Malaysia seksen yang sama adalah seksen 50 CJA :

50. Jurisdiction to hear and determine criminal appeals
[s50 substituted by Act A886]
(1) Subject to any rules regulating the proceedings of the Court of Appeal in respect of criminal appeals, the Court of Appeal shall have jurisdiction to hear and determine any appeal against any decision made by the High Court-

Akta sama seksen 3 juga memberi definasi berikut : "decision" means judgment, sentence or order, but does not include any ruling made in the course of a trial or hearing of any cause or matter which does not finally dispose of the rights of the parties;

10 ) PUBLIC PROSECUTOR V ABDUL RAHIM BIN HJ AHMAD & ORS [1988] 3 MLJ 272

[ 3 orang dituduh kerana merogol. Permohonan jamin hanya diluluskan pada kali ketiga apabila perubahan berlaku iaitu lapuran perubatan mangsa tidak menunjukkan rogol berlaku pada masa tersebut dan kes pembicaraan telah lewat].

Penjamin.

Rampasan jamin dibawah seksen 404 CPC.

404. Procedure on forfeiture of bond
(1) Whenever-
(a) it is proved to the satisfaction of the Court by which a bond under this Code has been taken; or
(b) when the bond is for appearance before a Court, it is proved to the satisfaction of that Court,
that the bond has been forfeited the Court shall record the grounds of such proof and may call upon any person bound by such bond to pay the penalty thereof or to show cause why it should not be paid.
(2) If sufficient cause is not shown and the penalty is not paid the Court may proceed to recover the same by issuing a warrant for the attachment and sale of the property belonging to that person.
(3) The warrant may be executed within the local limits of the jurisdiction of the Court which issued it, and it shall authorise the distress and sale of any property belonging to that person without such limits when indorsed by a Magistrate within the local limits of whose jurisdiction the property is found.
(4) If the penalty is not paid, and cannot be recovered by the attachment and sale, the person so bound shall be liable, by order of the Court which issued the warrant, to imprisonment in the civil prison for a term which may extend to six months.
(5) The Court may, at its discretion, remit any portion of the penalty mentioned, and enforce payment in part only.
(6) Nothing in this section shall be deemed to prevent the penalty, or any portion of it, of any bond under this Code being recovered under the provisions of the law relating to civil procedure in force for the time being.

Perkataan penting adalah jika alasan yang tidak mencukupi tidak di tunjukkan barulah wang jamin dirampas.

11) VALLIAMAI v PUBLIC PROSECUTOR [1962] 1 MLJ 280

[wang bon jamin sebanyak dirampas sepenohnya oleh Mahkamah. Keterangan menunjukkan penjamin telah hadir ke mahkamah untuk melepaskan dirinya sebagai penjamin. Diputuskan tindakan tidak wajar dan arahan rampasan wang penjamin di ketepikan]

12) KHOR EWE SUAN & ANOR v PUBLIC PROSECUTOR [1964] 1 MLJ 220.

[Rampasan bon jamin dibuat tanpa keterangan bersumpah oleh penjamin. Dipertikaikan tindakan ini berlawanan dengan seksen 404 dan tidak memberi peluang kepada penjamin menyoal balas saksi-saksi. Diputuskan tindakan tersebut tidak wajar].

13) KHOR HONG GUAN & MOH OOI HEE v REX [1950] 1 MLJ 85
( Kedua perayu dirampas wang jaminan apabila tertuduh yang mereka jamin gagal hadir di mahkamah session . Dalam kes ini mahkamah magistrate telah memindah ke mahkamah session dan penjamin mendakwa mereka hanya bertanggunjawab untuk menjamin tertuduh hadir di Mahkamah Magistrate bukan di Mah. Session. Rayuan diterima ]

14) RAMLEE & ANOR v PUBLIC PROSECUTOR [1969] 1 MLJ 42

[ Magistrate tidak mempunyai kuasa untuk mengarahkan bayaran melanggar jamin dibayar secara ansuran. Dalam kes juga penjamin telah mengambil langkah yang perlu bagi kehadiran tertuduh, oleh yang demikian arahan rampasan wang bon di ketepikan]

15) CHANG KHEE CHIEN & ANOR v PUBLIC PROSECUTOR [1980] 1 MLJ 183

[ Penjamin tidak perlu hadir setiap kali pembicaraan dilakukan].

Pembatalan jamin

16 ) MOHD JALIL BIN ABDULLAH & ANOR V PUBLIC PROSECUTOR ,1996-5 MLJ 564 .

Kedua-dua tertuduh ('pemohon-pemohon') telah dituduh pada 8 November 1987 di bawah s 353 Kanun Keseksaan (NMB Bab 45). Di bawah ruang kelima, Jadual 1 kepada Kanun Acara Jenayah (NMB Bab 6) ('KAJ') kesalahan tersebut adalah kesalahan boleh jamin dan ikat jamin dibenarkan sebanyak RM500 setiap orang. Kes itu telah ditangguhkan beberapa kali disebabkan ketidakhadiran pemohon-pemohon sama ada secara bersama ataupun secara individu. Ikat jamin dinaikkan pada mulanya kepada RM1,000 dan kemudiannya kepada RM3,000 dengan seorang penjamin setiap orang. Kes itu akhirnya ditetapkan untuk perbicaraan pada 21 Mei 1996 di mana pemohon-pemohon sekali lagi telah tidak hadir. Kesudahannya, waran tangkap telah dikeluarkan terhadap mereka. Pada 27 Mei 1996 pemohon-pemohon telah menyerah diri kepada mahkamah. Majistret yang bijaksana enggan menerima penjelasan pemohon-pemohon dan seterusnya telah membatalkan ikat jamin, menahan pemohon-pemohon dan menetapkan 25 Jun 1996 sebagai tarikh perbicaraan. Majistret yang bijaksana telah menolak permohonan ikat jamin. Maka, permohonan ini dibuat kepada Mahkamah Tinggi.

Diputuskan, membenarkan permohonan ini:

(1) Ungkapan 'shall be released on bail' di bawah s 387(1) KAJ adalah mandatori. Di bawah peruntukan ini, seorang yang dituduh melakukan suatu kesalahan yang boleh jamin adalah berhak untuk diikat jamin. Tidak timbul persoalan mengenai budi bicara dalam memberikan ikat jamin dan mahkamah mestilah mematuhi peruntukan di bawah seksyen tersebut (lihat ms 567D-G); R v Lim Kwang Seng & Ors
(1956) MLJ 178 diikut.

(2) Tujuan ikat jamin adalah untuk memastikan kehadiran tertuduh pada hari dan masa yang ditetapkan untuk menjawab tuduhan terhadapnya. Ianya bukanlah bertujuan sebagai hukuman dan ikat jamin yang keterlaluan seharusnya tidak diperlukan (lihat ms 567H); Zulkifflee bin Hj Hassan v PP
(1987) 2 MLJ 527 diikut.

(3) Majistret yang bijaksana adalah betul ketika beliau mengisukan waran tangkap terhadap pemohon-pemohon serta mengemukakan notis untuk menjawab kepada penjamin-penjamin untuk ketidakhadiran pemohon-pemohon. Beliau juga adalah betul ketika memberikan pemohon-pemohon peluang untuk didengar sebelum ikat jamin dibatalkan (lihat ms 567I-568A); Phang Yong Fook v PP

(1988) 1 MLJ 267 diikut.
(4) Walau bagaimanapun majistret yang bijaksana adalah salah ketika beliau memerintahkan supaya pemohon-pemohon ditahan. Ini adalah tidak sah dan tidak mematuhi undang-undang. Selepas membatalkan ikat jamin yang lama, majistret yang bijaksana sepatutnya memerintahkan ikat jamin yang baru dengan jaminan secukupnya seperti yang difikirkan wajar. Hanya jikalau pemohon-pemohon gagal melaksanakan ikat jamin tersebut barulah mahkamah mempunyai kuasa untuk menahan pemohon-pemohon (lihat ms 568B-C).

17 ) WONG KIM WOON V PUBLIC PROSECUTOR ,1999-5 MLJ 114

[ Kes ini betentangan dengan kes Mohd. Jalil. Perayu telah dituduh dibawah seksen 420 KK dan diberi jamin dibawah seksen 387 CPC. Perayu telah gagal hadir semasa bicara dan mahkamah telah membatalkan jamin dan di tahan remand. Perayu membuat rayuan. Diputuskan isu dalam kes ini bukanlah menawarkan jamin yang memang mendatori dibawah seksen 387 CPC, tetapi ia mengenai pelanggaran syarat jamin. Oleh yang demikian seksen 387 tidak relevan dalam kes ini. Tindakan membatalkan jamin pada kesalahan boleh dijamin adalah betul apabila perlanggaran syarat jamin berlaku].

Criminal Procedure -- - Revocation of - Appellant granted bail - Failure to attend court - Warrant of arrest issued - Revocation of bail - Whether appellant given opportunity to explain why bail should not be revoked - Whether revocation bad in law

HEADNOTES:

The appellant was charged with four counts of offences under s 420 of the Penal Code (FMS Cap 45) and was granted bail by the sessions court under s 387 of the Criminal Procedure Code (FMS Cap 6) ('the CPC'). The appellant failed to attend court on various hearing dates. A warrant was issued for the appellant's arrest whereby the appellant produced a medical certificate to explain he was ill. Dissatisfied with the explanation, the sessions court revoked and cancelled bail and committed the appellant to custody. Hence the appeal against the decision of the sessions court.
Held, ordering the sessions court to hear the appellant as to why bail should not be cancelled or revoked:

(1) The words 'shall be released on bail' in s 387(1) of the CPC, given their literal and natural meaning, mean that bail must be offered. To refuse to offer bail on the ground that the accused will put a fair trial into jeopardy is contrary to s 387 where bail is mandatory. The correct practice in bailable offences is to offer bail, and if there is evidence that the accused is interfering with witnesses or is conducting himself such as would put a fair trial into jeopardy, then only the question of revoking or cancellation of the bail arises for consideration (see pp 118D and 119C-D);

R v Lim Kwang Seng & Ors (1956) MLJ 178 and
Mohd Jalil bin Abdullah & Anor v PP (1996) 5 MLJ 564 followed.

(2) Whether bail was mandatory or discretionary, the issue here was the breach of the terms of a court order for bail. The fact that bail for the original offence was mandatory was irrelevant. Where there has been a breach of that fundamental term of the bail, the consequence must be that bail be revoked or cancelled. Here, there was no exercise of an inherent jurisdiction and there was no contravention of s 387(1) of the CPC, since bail had been granted. The cancellation or revocation was simply a consequence of breach of its terms, and specific statutory power to cancel or revoke bail in such circumstances was unnecessary (see pp 119G-H and 120C-D);
PP v Wee Swee Siang (1948) MLJ 116 distinguished.

(3) When the bail term has been breached and a warrant of arrest issued, the appellant, when he is brought before the court, must be given an opportunity to be heard first as to why the bail granted to him should not be revoked or cancelled. The fact he had breached the bail order is prima facie a valid reason for cancellation or revocation, unless he has a good explanation. In this case, it did not appear the appellant had been given such an opportunity. To that extent, the revocation or cancellation was bad in law (see pp 120G-H and 121D-E).
Obiter:( by the way)

Where bail is mandatory is offered once under s 387(1) of the CPC, the continuation of the bail must be based upon the continued compliance of its terms and the withdrawal of it when it is breached. For the sessions court to be obliged to extend fresh bail after breach or abuse of the earlier bail, albeit on enhanced terms, cannot be the intention of Parliament (see p 121A, C- D).

18 ) PHANG YONG FOOK v PUBLIC PROSECUTOR [1988] 1 MLJ 267

[Tuduhan telah dibuat atas kesalahan CBT dan tertuduh dibebaskan dengan jamin 1 juta. Pendakwa telah memohon untuk jamin dibatalkan kerana tertuduh menganggu saksi. Permohonan diluluskan. Tertuduh membuat rayuan. Diputuskan tidak ada keterangan lisan atau dokumen menyokong dakwaan yang dibuat. Oleh itu arahan pembatalan jamin diketepikan.]
